What Are the Penalties for an Aggravated DUI?

While all aggravated DUIs are felonies, the specific penalties can differ dramatically for an offense depending on factors including a driver’s blood alcohol content (BAC), previous drunk driving offenses, who was present in the car, and if any bodily injury occurred. Typically, the first offense for aggravated DUI is a class four felony punishable by four months in prison.
