Categories of Felonies in Arizona

Arizona classifies felony charges into different classes, with each class carrying different penalties. If you are facing felony charges, it can be beneficial for you to understand which class of felony you face in order to understand what types of punishments are associated with it.

Felony charges in Arizona are classified by the following:

  • Class 1: This is the most serious type of felony charge. First and second degree murder are the only Class 1 felonies in Arizona. A first degree murder conviction can be punishable by death or life in prison, while second degree murder can bring 16 years to life in a state penitentiary.
  • Class 2: Offenses such as producing or creating child pornography are Class 2 felonies. A conviction of a Class 2 felony can bring up to 12 ½ years in state prison.
  • Class 3: Class 3 felonies such as cultivation of four or more pounds of marijuana can bring sentences up to eight years and nine months in prison.
  • Class 4: A Class 4 felony offense can bring up to three years and nine months in prison. The theft of property worth between $3,000 and $4,000 is considered a Class 4 felony.
  • Class 5: Felony offenses which legislators have not specified a class are oftentimes charged as Class 5 felonies. Pimping and pandering prostitution is considered a Class 5 felony. Conviction of a Class 5 felony can bring up to two years and six months in state prison.
  • Class 6: The least serious felony offenses are classified as Class 6 felonies. These offenses can bring a maximum of two years in prison.

In addition to the above penalties, all felony convicts can be required to pay fines up to $150,000. Those who are convicted of drug crimes can be required to pay more than this amount.

Prison sentences can be lengthened if a person has history of previous felony convictions, if a crime was particularly heinous, or if the victim of the crime was older than age 65.

Arizona employers are no longer allowed to ask applicants about their criminal history in a job application. This only applies to the public sector but not the private sector. This policy called “Ban the Box” makes Arizona a friendlier state to felons. “Ban the Box” policy makes it much easier for felons to prove their ability to perform the job without the knowledge of criminal history lowering their chances of getting the job.

Can a Felon Get a Passport in Arizona?

Someone convicted of a felon cannot get a passport. If a convicted felon crosses international boundaries during the crime, they will have their passport revoked. The disqualification is also in effect throughout the prison time.
