What Are the Penalties for an Aggravated DUI?

While all aggravated DUIs are felonies, the specific penalties can differ dramatically for an offense depending on factors including a driver’s blood alcohol content (BAC), previous drunk driving offenses, who was present in the car, and if any bodily injury occurred. Typically, the first offense for aggravated DUI is a class four felony punishable by four months in prison. In the case where a child is in the car, it can be charged as a class six felony punishable by three months in prison.

To make matters worse, the consequences of a DUI can extend well after a prison sentence ends and initial fines have been paid. Once an insurer becomes aware of a conviction for aggravated DUI, your insurance rates are likely to increase substantially over the next few years. This can be an increase of hundreds if not thousands of dollars per year. After a license suspension ends, any vehicle you do operate must be fitted with an ignition interlock device (IID), typically for a period of two years. Additionally, because an aggravated DUI is a felony offense, you may also lose your right to vote as well as the right to possess a firearm.
