Narcotics Possession in Arizona

As one of the most highly addictive and abused narcotic substances in the Grand Canyon State, even simple cocaine possession charges can carry harsh criminal consequences. Possession of narcotics is considered a Class 4 felony and is punishable by a maximum of three years in prison, along with a fine of at least $2,000 or an amount equal to three times the value of the amount of cocaine found in a person’s possession. In certain rare cases involving a minimal amount of drugs or a defendant who has not been previously convicted of a felony, these charges may be reduced to a Class 1 misdemeanor.

To be convicted of possession, the prosecution must be able to prove:

  • The defendant knowingly possessed cocaine, and;
  • Exercised their control or had the ability to exercise control over the drug.

In situations where a defendant is found with an amount of cocaine that exceeds the statutory threshold of 9 grams of powder or 750 milligrams of rock cocaine, charges may increase to possession of cocaine for sale, a Class 2 felony with a potential sentence of up to 10 years in prison. Penalties can increase further depending on a defendant’s history of past convictions and whether or not the arrest took place in a drug-free zone, such as near a school.
