In civil and criminal cases, witnesses and experts are often called to
testify during court proceedings. There are federal and state laws in
place designed to make sure these witnesses and experts are there to tell
the “whole truth and nothing but the truth,” and not there
to further their own interests or the interest of the individual in question.
It is called perjury law.
Perjury is the crime of intentionally making a false statement under oath
in judicial or administrative proceedings. To lie or misrepresent the
truth in your testimony is a criminal offense as is encouraging another
individual to commit perjury. This is called subordination of perjury.
Arizona law (ARS 13-2702) says that a person commits perjury by making
either, one, a false sworn statement in regard to a material issue, believing
it to be false, or two, a false unsworn declaration, certificate, verification
or statement in regard to a material issue that the person subscribes
as true under penalty of perjury, believing it to be false. In Arizona,
perjury is a class 4 felony. A.R.S. 13-2703 also classifies false swearing.
False swearing is a similar charge to perjury and it occurs when a person
commits false swearing by making a false sworn statement, believing it
to be false. in Arizona, false swearing is a class 6 felony.
