Accidental Shooting With a Stolen Gun - Aggravated Assault Lawyer Mesa AZ

|

Recently, in Tempe, Arizona, a Chandler man accidentally shot his friend with a stolen gun. The handgun reportedly had a malfunction that the man was trying to fix when the gun fired, Tempe police Sgt. Jeff Glover said. The wounded man was taken to the hospital where he was listed in stable condition.

According to Tempe police, the other man was booked and released on suspicion of discharging a firearmwithin city limits, a felony, and false reporting, a misdemeanor. Originally, the men said they had been shot at. Glover said the felony count is being investigated, but if the man in the hospital decides to aid in prosecution, Tempe police could recommend an assault charge. “This situation is particularly dangerous because a bullet like that doesn’t have an aim on it and could hit anyone,” he said.

Arizona weapons charges are usually serious in nature. While simple possession or possession of a concealed weapon may be considered lesser charges, they can still result in mandatory jail time. The use or possession of a deadly weapon in the commission of a crime will result in more severe penalties and most likely felony charges.

It’s important to remember that, in Arizona, a deadly weapon isn’t always a firearm. Deadly instruments refer merely to any weapon that can be used in a manner to cause serious injury or death. This includes knives, baseball bats, crowbars or even a fist. State and federal weapons laws are complex. Therefore, you need a knowledgeable and experienced lawyer on your side. Naegle & Crider Criminal Defense Attorneys will look into constitutional issues and do a thorough investigation of your case.

Being in possession of a firearm while your right to possess a firearm has been restricted (usually due to a felony conviction) can also result in a charge of misconduct involving weapons, which is a Class 4 Felony.
